EDMONTON - The mother of one of four Alberta Mounties killed by a gunman in Mayerthorpe has lost her last legal battle to keep her son's body close to her home.

The provincial Court of Appeal has refused to overturn an order allowing Const. Leo Johnston's widow to have his body exhumed from a cemetery in Lac La Biche, Alta., and reburied in the RCMP cemetery in Regina.

The three-member panel ruled that the wife's wishes overrule those of the mother.

Grace Johnston says she's devastated by the ruling.

She says she still visits her son's grave frequently.

Leo Johnston was one of four Mounties shot dead by James Roszko in March of 2005 as they stood guard over stolen car parts and a marijuana grow-op discovered on his property in northwestern Alberta.
